Privacy Policy

Metropolis Healthcare Limited(“Metropolis Healthcare”) is concerned about the privacy of its users (hereinafter referred to as “You” “Your” “Yourself”) accessing mobile application - Metropolis Healthcare Ltd. (“APP”) and has provided this Privacy Policy (“Policy”) to familiarize you with the manner in which Metropolis Healthcare collects, uses and discloses your information collected through the APP. BY USING THE APP, YOU AGREE TO THE TERMS AND CONDITIONS OF THIS POLICY. IF YOU DO NOT AGREE WITH THE TERMS AND CONDITIONS OF THIS POLICY, PLEASE DO NOT PROCEED FURTHER TO USE THIS APP.

1. Information and Usage

This Privacy Policy explains how Metropolis Healthcare collects personal and non-personal information, classified as mandatory or voluntary and uses, discloses, and protects such information through the APP.

‘Personal Information’ is data that can be used to uniquely identify or contact a single person (“Personal Information”). Personal Information for the purposes of this Policy shall include, but not limited to, information regarding your name, address, contact number, date of birth, gender, e-mail address, locations, Profile Photo, medical records, history, etc. Further for the availability of certain services provided by Metropolis Healthcare through its APP, the application may obtain with your approval certain accessibility permissions including your locations, device audio and video access, browser details, device storage access, Biometric and other similar function accesses as may require for providing the services.

You may need to provide Metropolis Healthcare with your personal information during the course of using services of Metropolis Healthcare, for instance, creating a User ID; provide information in your account while registering on the APP; or provide financial information while making an online purchase, upload content, participate in any online survey or contest, communicate with Metropolis’s customer service by phone, email or otherwise, provide reviews for the content available on the APP.

App Permissions that we capture

a) Location: It is recommended that you set your location sharing 'Always' as it helps us to show you location-specific data like the availability of products, Nearest Centres. You can change this permission anytime.

b) Access Wifi State: This permission helps us to optimize your experience based on the Wifi’s strength and signals, especially to reduce chances of functionality drop due to network issues. This ensures that the user gets a prompt every time the network is unavailable and not stable.

c) Camera: To allow you to take your photo as Profile Picture or take a photo of prescriptions & directly upload it to the app.

d) Photos/Media/Files Media access: Permission is needed to store and retrieve your uploads such as prescription uploads on your device. The App also use Write external storage permission as this enables you to download your report.

e) Receive SMS: This helps us to send you payment-related and booking-related SMS

Metropolis Healthcare uses Personal Information in order to process safe and provide hassle-free service experiences in a better manner to you. Metropolis Healthcare collects only such Personal Information which is relevant for services availed by you through our APP, in order (i) to record, support and facilitate your participation in the activities you select, analyze your preferences, to provide you with a customized APP/App experience; (ii) to notify you of any updated information about latest promotional content and offers on products and services of Metropolis Healthcare, to assist you with customer service or technical support issues, to follow up with you after your visit, to otherwise support your relationship with Metropolis Healthcare or to prevent fraud and unlawful use.

2. Disclosure of your Personal Information

Metropolis Healthcare does not share, sell or lend out your Personal Information about you with other people (save with your consent) or non-affiliated companies except to provide products or Services under the Terms of Use or this Privacy Policy or otherwise for the following uses:

  1. To statutory authorities, departments or any other Government body as and when required by them for collecting or processing health information of the state/country
  2. To submit under a legal obligation of law of land in response to court orders, or legal process, or to perform our legal rights or defend against legal claims
  3. to provide the Personal Information to Doctors and other authorized health care professionals who need to access your laboratory report for your proper diagnosis.
  4. to insurance companies, hospitals, physicians or third parties with our billing department for payment purposes.
  5. to support our healthcare operations, such as performing quality checks on your testing, for teaching purposes, or for developing normal reference ranges for the tests we perform.
  6. to other laboratories/medical institutions for research and development purposes from time to time, to reveal general statistical information about our App and visitors, such as number of visitors, number and type of services purchased, etc.
  7. to transfer/disclose Personal Information about you to trusted partners, may or may not be for gain, to promote certain products/services for commercial purposes, without any prior notice to you.

Further, you agree that we may share your Personal Information for the following categories of activities from time-to-time:

Advertisements

  1. When you enter Personal Information on any form of an advertiser, such information is simultaneously collected by APP and the advertiser. The Personal Information is used by APP in accordance with the terms of this Privacy Policy and is used by the advertiser as per the advertiser's prevalent privacy policies. Because we do not control the privacy practices of these advertisers, you should evaluate their practices before deciding to provide the said information.
  2. APP may also aggregate (gather up data across all Accounts) Personal Information and disclose such information in a non-personally identifiable manner to advertisers and other third parties for other marketing and promotional purposes.

Other Corporate Entities.

The Company shares much of the data, including Personal Information about you, with its parent, affiliates, subsidiaries, and joint ventures that are committed to serving your online needs and related services, throughout the world. To the extent that these entities have access to your Personal Information, they will treat it at least as protectively as they treat information they obtain from their other users. The Company's parent, affiliates, subsidiaries, and joint ventures follow privacy practices no less protective of all users than our practices described in this document, to the extent allowed by applicable law. The Company, its parent, affiliates, subsidiaries, its joint ventures, or any combination of such, will share some or all of your Personal Information with another business entity should we plan to, merge with, or be acquired by that business entity.

Metropolis DOES NOT trade or sell Your Personal Information in any manner, except as specified herein or if express consent is sought from you. Personal Information provided by you is used only: (a) to facilitate Your use of the APP; (b) to respond to Your inquiries or fulfil Your requests for information about the various services; (c) to provide You with information about Metropolis’s products/services and to send You information, materials, and offers from Metropolis; (d) to send You important information regarding the APP, changes to Metropolis’s terms, conditions, and policies and/or other administrative information; (e) to send You surveys and marketing communications that Metropolis believes may be of interest to You; (f) to personalize Your experience on the APP and Metropolis’s other APPs by presenting advertising, products and offers tailored to You; (g) to help You address Your problems with the APP including addressing any technical problems; (h) if You purchase any content or avail of any service from the APP, to complete and fulfil Your purchase, for example, to have Your payments processed, communicate with You regarding Your purchase and provide You with related customer service; (i) for proper administering of the APP; (j) To conduct internal reviews and data analysis for the APP (e.g., to determine the number of visitors to specific pages within the APP); (k) to improve the services, content and advertising on the APP; (l) to protect the integrity of the APP; and (m) to respond to judicial process and provide information to law enforcement agencies or in connection with an investigation on matters related to public safety, as permitted by law.

Any change will be communicated through an amendment in policy.

  1. Metropolis shares access to certain limited information maintained on APP including Personal Information about you, with its parent, affiliates, subsidiaries, joint ventures, entities engaged by Metropolis Healthcare for certain services (Business Partners) that are associates for providing your desired services through our APP. Metropolis and its Business Partners in whatsoever manner will share some or all of your Personal Information with another business entity as a part of the restructuring and /or any other similar arrangements..

You acknowledge that apart from Your Personal Information if you upload any content on the APP, such content may contain information including Personal Information and the same may be available to the other users of the APP. Metropolis will not be liable for the disclosure and dissemination of such Personal Information to third parties. Metropolis may disclose aggregated information about the use of the APP, but it will never contain Personal Information. Metropolis does not disclose Personal Information to third parties in the normal course of operations. However, in situations when Metropolis is legally obligated to disclose information to the government or other third parties, Metropolis will do so. Metropolis implements standard measures to protect against unauthorized access to and unlawful interception of Personal Information. However, no internet site can fully eliminate security risks.

3. Shared Personal Information

You are required to submit Your information at the time of making an online purchase on the APP. Metropolis Healthcare uses an online payment gateway that is operated by a third party and the information that you share with Metropolis is transferred and shared with such third-party payment gateway operator. The said operator may also have access to your online purchase history/details that you make from the APP. However, Metropolis Healthcare is not responsible for acts of such third-party gateway. Extremely sensitive information like Your credit-card / E-Payments details are transacted upon secure sites of approved payment gateways which are digitally under encryption, thereby providing the highest possible degree of care as per current technology. You are advised, however, that internet technology is not 100% safe, and You should exercise discretion on using the same.

4. Security

Metropolis Healthcare strives to ensure the security, integrity and privacy of Your Personal Information and to protect Your Personal Information against unauthorized access or unauthorized alteration, disclosure or destruction. For this purpose, Metropolis adopts internal reviews of the data collection, storage and processing practices and security measures, including appropriate encryption and physical security measures to guard against unauthorized access to systems where Metropolis stores Your personal data. Metropolis is not responsible for any breach of security or for any actions of any third parties that receive Your Personal Information. The APP also linked too many other sites and we are not/shall be not responsible for their privacy policies or practices as it is beyond our control. Notwithstanding anything contained in this Policy or elsewhere, Metropolis shall not be held responsible for any loss, damage or misuse of Your Personal Information, if such loss, damage or misuse is attributable to a Force Majeure Event (as defined below). A “Force Majeure Event” shall mean any event that is beyond the reasonable control of Metropolis and shall include, without limitation, sabotage, fire, flood, explosion, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorized access to computer data and storage device, computer crashes, breach of security and encryption, etc.

5. Disclosure

Metropolis will use the information only in accordance with the Policy under which the information was collected unless we have received explicit authorization. Metropolis may disclose any information Metropolis may have about You (including Your identity) if Metropolis Healthcare determines that such disclosure is necessary for connection with any investigation or complaint regarding Your use of the APP, or to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) Metropolis’s rights or property, or the rights or property of users of the APP, including Metropolis’s customers. Metropolis always reserves the right to disclose any information that Metropolis deems necessary to comply with any applicable law, regulation, legal process or governmental request. Metropolis also may disclose Your information when Metropolis determines that applicable law requires or permits such disclosure, including exchanging information with other companies and organizations for fraud protection purposes. You acknowledge and agree that Metropolis may preserve any communication by You with Metropolis through the APP or any Service, and may also disclose such data if required to do so by law or if Metropolis Healthcare determines that such preservation or disclosure is reasonably necessary to: (1) comply with legal process; (2) enforce this Policy; (3) respond to claims that any such data violates the rights of others; or (4) protect the rights, property or personal safety of Metropolis, its employees, users of, or visitors to, the APP, and the public.

6. User Discretion

You can always choose not to provide information and in such cases, if the information required is classified as mandatory, you will not be able to avail of that part of the Services, features or content. You can add or update Your Personal Information on a regular basis. When You update information, Metropolis will keep a copy of the prior version for its records. Metropolis may, if You so choose, send direct advertisement mailers to You at the address given by You. You have the option to opt out of this direct mailer by clicking on the unsubscribed link option attached to e-mail. Metropolis respects Your privacy and if You do not want to receive e-mail or other communications from Metropolis Healthcare, please report to Metropolis at support@metropolisindia.com . If you do not want Metropolis to use Personal Information that Metropolis to You, please report to Metropolis at support@metropolisindia.com

7. General Provisions

You agree that Metropolis Healthcare is not responsible for any of your Personal Information in public areas of the APP such as in comments, chat rooms etc., or in the APP’s searchable database, such information used by others on which Metropolis do not hold any control and therefore we do oblige to take any responsibility for the use of information by third parties based on the information you disclose or otherwise make available in public areas of the APP

You agree and confirm that You comply with the requirement of the minimum age required under the locals’ laws applicable for restrictive access of services of metropolis and information/data/ content of the APP.

By accessing the APP, you have agreed to the terms set out in this Policy. This Policy should be at all times read along with the Terms of Use of the APP. Unless stated otherwise, the Policy applies to all information that Metropolis has about You and Your account. By using this APP and the products, content and services provided on the APP, you agree and acknowledge that Your Personal Information collected through the APP may be transferred across national boundaries and stored and processed in any country around the world. You also acknowledge that in certain countries or with respect to certain activities, the collection, transfer, storage, and processing of Your information may be undertaken by trusted third-party vendors or agents of Metropolis such as credit card processors, web hosting providers, communication services, and web analytic providers, to help facilitate Metropolis in providing certain functions.

Metropolis may make changes to this Policy, from time to time at Metropolis’s sole discretion or on account of changes in the law. Metropolis will not reduce Your rights under this Policy without Your explicit consent. Metropolis may e-mail periodic reminders of the notices and conditions unless You have instructed Metropolis not to, but You should check the APP frequently to see recent changes. Notwithstanding the above, Metropolis shall not be required to notify You of any changes made to the Policy. The revised Policy shall be made available on the APP. Your continued use of the APP, following changes to the Policy, will constitute Your acceptance of those changes. If You choose to visit the APP, your visit and any dispute over privacy are subject to this Policy and the APP’s Terms of Use. In addition to the foregoing, any disputes arising under this Policy shall be governed by the laws of India.

8. Dispute Resolution & Jurisdiction

The Privacy Policy and Terms of Use shall be subject to the laws of India and shall be subject to the exclusive jurisdiction of the competent courts of Mumbai, India.

In accordance with Information Technology Act 2000 and rules made thereunder, the name and contact details of the Grievance Officer who can be contacted with respect to any complaints or concerns including those pertaining to breach of Metropolis’s Terms of Use, Term of Offer for Sale and other polices or questions are published as under:
